The legal team is responsible for representing the members and the EPP: in mediation if necessary; the Industrial Relations Authority; before the Labour Court and as Senior or Junior Counsel at the Court of Appeal. The legal team will play a role in reporting to members on the decisions of the Labour Authority and the Court. The legal strategy also reflects the range of issues raised by its members and the environment in which the PSA operates. This includes not only labour law, but also the CCA and matters of professional competence and discipline. The objective of the PSA is to build a trade union organization capable of influencing the social, political, economic and industrial environment in order to promote the individual and collective interests of PSA members. As part of the Quality Partnership, PSA works with other parties, particularly employers, industry and government, to achieve positive results for all parties. The quality partnership is based on the understanding that the parties (union, employer, government) have many common interests, in particular the provision of quality public services and quality jobs. Partnership for Quality means that PSA members (through their union) work in partnership with employers and government to create the best possible public services for New Zealanders. Partnership for Quality means that PSA`s legal strategy is workplace-focused, with a focus on problem solving, quality and timely representation and advice, skills development and empowerment. PSA members have access to a legal service provided by lawyers, McNally Jones Staff. This service goes beyond work-related matters where you may need the services of a lawyer.
Interacting with organizational practice means that the relationship with organizers is very important. Organizers must be the face of the union that manages relations with members in difficulty. Your advice in the early stages of litigation can ultimately contribute to the success or failure of a lawsuit. The knowledge and skills of the organisers therefore have a direct impact on the work of the legal department and its overall workload. Organizational capacity and responsibilities are therefore important considerations for the legal team, as is their relationship with the Assistant Secretaries who lead the organizational function. Guidelines and procedures for litigation The policy and procedure relating to the course of legal cases are set out in Part II. The revised Directive was developed to provide a clearer framework for deciding whether and how to take legal action beyond the workplace in individual cases. Other teams within the PSA strategy and support function are less important to the team`s objective, but they can and should support each other when their responsibilities overlap. The relationship with the policy team is of particular importance, for example in the development of new guidelines and the preparation of submissions on legislative amendments.
In many cases, you may not know what rights you have, and accessing appropriate remedies in a lawsuit can be costly and difficult. As a result, many people do not exercise their rights and are more likely to ignore legal issues, leading to unnecessary complications. c) advise the legal team on the potential costs of handling the case, taking into account the resources that must be used and the potential costs that may be awarded to the member (paid by the PPE) and/or to the PPE in case of failure; These are just a few issues to consider when choosing legal error insurance, which is crucial to protecting your law firm from lawsuits and claims involving errors, omissions, negligence, poor case management, or other allegations. But not all insurance against lawyers` malpractice is created equal. We understand that choosing the right protection can be overwhelming – that`s why PSA is here to help. The organizers are responsible for cases in their region and are the contact between the legal team and the member. In most cases, organizers are responsible for referring cases to mediation in consultation with the legal team. Delegates usually deal with the early stages of disputes and personal grievances.
While they should also work through their organizer, their legal knowledge and skills will be important in carrying out the business. The possibility of delegating is therefore also an important aspect for the legal team. When we say we really understand the legal industry, we mean it. Our legal error insurance team is led by Steven Sherman, J.D., who provides unique information needed to provide the most appropriate professional liability insurance for lawyers. The Legal Environment The Labour Relations Act (ERA) is the main legal framework within which the PSA operates. The purpose of the law is, as stated in § 3: “1. Organizers must inform the legal team before deciding that a case will be referred to mediation. The legal team will inform the organizer and the assistant secretary of any concerns regarding the mediation. PfQ forces all parties in the union to think and act strategically.
