Legal Define Adjacent

Adjacent, adjacent, adjacent, side by side meaning to be nearby. Neighbors may or may not involve contact, but always imply the absence of something similar in between. A house with an attached garage certainly involves meeting and touching each other at a point or line. Having adjacent rooms in the adjacent hotel implies contact on all or most of one side. Legacy submits that the term “adjacent” can have only one meaning, which is to be “contiguous”, and it is not disputed that the location of the park structure does not touch the boundary line, even if it is within 100 feet. The Court concluded that the simple and ordinary meaning of “adjacent” means “to be near, border, or, neither far nor far, near but not touching”. In addition, neighborhoods by definition go to the middle of streets, which has led to a touch of lines per neighborhood. As a result, the BOA correctly interpreted its own code and denied approval. The evidence showed that the BOA did not take minutes of working sessions to meet with TOMA, but has since started. Therefore, a permanent injunction is moot and Legacy has not been able to prove imminent or irreparable harm.

The court ruled that the TOMA does not specify the term “convened,” so it is not necessarily a violation for council to meet in camera for business sessions without first opening the meeting publicly through a formal process. In addition, the evidence showed that the purpose of the closed sessions was to seek appropriate advice from their counsel on outstanding issues and was therefore an authorized item for the executive meeting. Eventually, the court cancelled the attorney`s fees and ruled in favor of the BOA. Nearby or nearby; adjacent. The difference between adjacent and adjacent seems to be that the former implies that the two objects are not very far apart, although they do not really touch each other, while neighboring imports make them so connected or connected that no third-party objects intervene. 978. This is an appeal by the Board of Adjustment, in which the Dallas Court of Appeals set aside the court`s award of relief to Legacy Hillcrest Investments (“Legacy”) in an area dispute. Legacy owns properties in the city surrounded by single-family, multi-family areas, parks and offices. Legacy requested zoning changes over a ten-year period to reflect planned developments. When last applied in 2011, Legacy applied for a permit for above-ground parking next to a single-family area. The Board of Adjustment (“BOA”) denied approval and Legacy appealed to the District Court. After a three-day hearing, the trial court ruled in favor of Legacy, issued a permanent injunction against violations of the Texas Open Meeting Act (“TOMA”), and awarded attorneys` fees. The BOA appealed. Supported by Black`s Law Dictionary, Free 2nd ed., and The Law Dictionary. If you would like to read this review, click here.
