As a junior partner in a dental practice, I had entered into a partnership agreement with the senior partner with buyout arrangements a few years earlier. Lance was able to negotiate a reduction in the repurchase price of more than $100,000 because he was able to cancel the formula used to set the price in the agreement drafted by the other lawyer. These savings have been a huge financial return for me for only a few thousand dollars in legal fees. I would not hesitate to recommend Lance for other business transactions that require complex, prudent and creative legal skills. I owned an income property with three co-investors and when we sold it, we went to a securities company to organize our sale. We have agreed to repurchase a substantial portion of the purchase price as seller financing in the form of a promissory note secured by the buyer by a fiduciary deed. Unbeknownst to us, the buyer arranged for the property to be sold to another buyer at the same time, while withdrawing a significant portion of the purchase price as seller financing in the form of a promissory note secured by a trust deed. We received no income on the bill, the property lost value due to waste, and the trust deed appeared to become worthless. Lance Davidson was highly recommended as a real estate lawyer, so we kept him.
Others have urged us to take legal action immediately to attract attention and scare the securities company. Lance held back. Our case was complicated by the imminent foreclosure action of another preferred creditor on the property, which, although it should have been younger for us, would have erased all our interest in the property. Instead, Lance negotiated with the securities company, the securities insurer and the secured creditor and issued them against each other. Remarkably, instead of waiting years for the note to expire for a property that is losing value, we got all our money back immediately. We received virtually everything we were entitled to by settlement – approximately 97% – including principal and interest on promissory notes, as well as most of our legal fees. And since the settlement by definition means giving up something in return, we eliminated for a pittance, which resulted in years of stress, huge legal fees and expenses, time spent negotiating a case, etc. could have been. In fact, when I hired Lance, I expressed my hope of getting a certain amount, of course not really expected; Instead, Lance scored almost 30% higher for us than I had hoped for – an amount well above what I expected! We thank Lance and his company and highly recommend him. Lance Davidson`s legal advisory and litigation services achieve three goals for his clients: accountability, cost reduction and profit generation. The scope of its legal services goes beyond the following list. Our property was a few weeks away from foreclosure, and in order to maintain our creditworthiness and work with – not against – our lender, we made a short sale.
We had obtained a legal opinion that the lender could not sue us because of the absence or difference between the balance of the loan and the proceeds of the sale received from the bank. Soon after, however, we were sued by the lender for the gap and kept Lance Davidson with the defense. Mr. Davidson explained that neither the legal language nor the most relevant case protected us – the law expressly prohibits defects only after a escrow sale, not after a short sale, and the precedent, unlike ours, did not include our consent for the bank to inform us of the default and its right to remedy it. Because if we had no responsibility, why would the bank sue us for the default? Our other lawyer had apparently only read the “Cliff Notes” version of the law and jurisprudence. M. Davidson filed a motion to dismiss and convinced the judge in oral arguments against the bank`s lawyer that the intent of the case and the limitation period for the default action were time-barred. The judge also agreed that the bank`s warning did not give enough time. We learned that a bankruptcy recovery attorney who lectures on anti-disability laws and practices for creditors and debtors throughout Arizona was “amazed” at your success.
And significantly, your success allowed us to recover all our legal fees, so we got a free defense! But above all, since the judge`s decision effectively eliminates debt as a remedy, there is no debt relief, so we do not owe a 6-figure tax liability! You have saved us many, many times what your legal fees would have been in debt and tax liability. Thank you, thank you Lance S. His legal successes are a testament to his ability to provide superior and imaginative representation to commercial organizations, government agencies and individuals. Read More I`ve been fortunate to own a fast-growing business, and an important aspect of my business is my use of and trust in Lance Davidson as legal counsel. For example, when my business kept a marketing business, Lance wrote a marketing agreement that saved me money and stress. And when I had to grow the business with a colleague, Lance specifically designed a lucrative licensing agreement to avoid the pitfalls of franchising. He doesn`t say what I can`t do; Lance finds a way to achieve what his fellow lawyers would often describe as unattainable. Finding a business lawyer who is both creative and familiar with business issues, both conceptually and practically, is not as easy as one might think. I would recommend Lance Davidson and his firm without hesitation to anyone looking for top-notch, useful, economical and even profitable legal advice for their business. There are times when a lawyer`s keen eye is worth much, much more of his fees. I told Lance Davidson that he was a fantastic lawyer, and now I`ll tell you.
As a result of Lance`s review of a contract – and his review directly contradicted my California lawyer`s previous review of the same contract – I was able to get four times as much on the return on my investment. Years earlier, I had entered into a partnership agreement to acquire valuable land, and my partner had written into our contract terms that were very favorable to him. I made changes to the contract and overlooked the fact that my partner had not accepted all my changes. My California attorney reviewed the contract and told me that I had waived my rights. Ugh. However, Lance, who was licensed not only in Arizona but also in California, came to the opposite conclusion. So I hired Lance to represent me. He sent two letters, one to my business partner and the other to the trust company involved in the transaction in which my partner was to take over the lion`s share of the proceeds of the sale. In a few months, as a direct result of Lance`s inspection and execution, I received four times what I thought was justified, in cash, based on the previous legal opinion of my former lawyer. And Lance`s fees for good advice were much cheaper – less than a third – than the fees I paid my former lawyer for bad advice, and were overshadowed by the proceeds of the deal.
Mr. Davidson provided me with legal assistance in a real estate transaction that became both tedious and contradictory. These were also ambiguous issues, with the possibility of multiple outcomes. He demonstrated a clever knowledge of Arizona`s real estate laws. Throughout the process, Mr. Davidson has been patient and calm, contrary to my fears. He did not seek a legal dispute instead of a solution, and the solution he reached was extremely satisfactory. He has been an excellent advisor, advisor and protector, and I am very grateful to him for his very effective negotiations.
