In 2018, we commissioned a study on the legal aid resource test, which found that on March 15, 2022, the government launched a consultation on changes to increase the number of people eligible for legal aid. This limit is set at £8,000 for all civil legal services, with the exception of those relating to an immigration matter set out in Regulation 8(3), which is limited to £3,000. To inform our response to this consultation, we commissioned Professor Donald Hirsch to continue his research on the impact of the proposed changes to the resource requirements for legal aid. Read the guidelines of the draft public law on captured capital The remaining amount of capital, after deduction of provisions and/or non-considerations, is the available capital of your client. You must evaluate capital resources in all cases. However, if your client receives financial assistance under sections 4 or 95 of the Immigration and Asylum Act 1999 from the National Asylum Support Service (NASS), they will only pass income and capital tests for controlled labour immigration and asylum issues. For example, if the capital is in an account such as an ISA, that account requires a recent copy.
September 2018 – We responded to the government`s review of changes to legal aid at LASPO; We also commissioned further research on resource testing and how capital eligibility requirements prevent people from accessing justice Legal aid is a lifeline for people who normally live in poverty to help in times of crisis, such as: if they are at risk of deportation or seek protection from an abusive partner. However, in order to access legal aid, people must be means-tested. From 6 April 2009, the lower limit for available capital is £3,000, the upper limit is £6,750 and for personal injury £8,560. From 12 January 2022, bereaved families will be able to request legal representation through Exceptional Case Funding (ECF) without means test during investigations. The initial threshold of capital available in ceremonial cases corresponds to the current limit of advice and support. The current limit can be found in the key card with tips and help. The Ministry of Justice says the proposals should mean extending eligibility for legal aid to: for example, if the case can only be heard by the Supreme Court, for example. for murder, negligent homicide or rape, we will use the cost of the intermediate case outside of the legal process, unless we are informed that the case is being brought before the courts. We also investigate the nature of the matter in question before we can determine whether paying their own legal fees would result in unreasonable hardship. When your client reaches retirement age, we may ignore certain aspects of their capital based on their disposable income.

However, if the number exceeds the current £1,716 limit, we will compare the excess amount with the median cost of the deal. If the excess amount above the £1,716 limit is less than the average cost of the case, the client is eligible for available capital. If this number is higher than the average cost of the file, the client is not eligible for capital.
If you have been told that you must contribute to your legal aid bill and have been asked to set up a direct debit, you can download a direct debit mandate form that you must print, complete and send to LSANI. The domestic violence regime means that legal aid can be granted to applicants for non-harassment orders, including applicants who would normally be outside the scope of legal aid. However, the applicant may be required to make a financial contribution from his income and/or savings (capital). The applicant must also meet all the conditions of the performance tests. In all cases where an applicant`s weekly disposable income exceeds £234 or their principal exceeds £3000, their lawyer must complete a “financial assessment form” which can be found on the agency`s website on the “LAMS Legal Aid Supporting Documents” page. The lawyer then uploads it to the agency`s online legal aid management system (LAMS) as proof of the legal aid application. Since then, prices have increased by 40%. This means that fewer and fewer people are entitled to legal aid each year. The legal aid resources test has not been updated to reflect inflation since 2009. The LAA waives all upper limits if your client applies for legal aid for a domestic violence or forced marriage protection order.
However, a contribution may be required. If your client lives with a spouse/partner and/or dependent or child, a standard capital subsidy is deductible for each dependant at the rates specified in the current counselling and support key card.
